Kaimai Plumbing and Gas Limited
01. General
These Terms of Trade apply to all plumbing and gas fitting services provided by Kaimai Plumbing and Gas (“we”, “us”, “our”). By accepting a quote, booking work, or allowing work to commence, you (“the customer”) agree to these terms.
02. Quotes & Estimates
Quotes are valid for 30 days unless stated otherwise. Quotes are based on the information available at the time and may change if additional work is required. If unforeseen issues arise (including hidden damage, non-compliant installations, or access issues), we will discuss any variations before continuing where practicable. Estimates are indicative only and may change depending on actual time and materials required.
03. Pricing & Payment
Payment is due on completion of work, unless otherwise agreed in writing. We accept bank transfer and other agreed payment methods. Overdue invoices may incur interest at 5% per month and any reasonable debt recovery costs. We reserve the right to suspend future work if payment terms are not met.
04. Travel & Service Areas
Our primary service area is Katikati and the Western Bay of Plenty. We also travel to Tauranga, Waikato, and Coromandel for select jobs by arrangement. Travel outside the primary service area may incur a travel fee, which will be quoted befeore work commences. Travel fees cover time, fuel, and vehicle costs and are in addition to the standard quote for labour and materials.
05. Emergency Call-Outs
Emergency and after-hours work may incur higher rates. Call-out fees apply once attendance has occurred, regardless of outcome. Travel fees may apply for emergency work outside our primary service area.
06. Access & Safety
The customer must provide clear, safe access to the work area. We reserve the right to stop work if unsafe conditions are present. The customer is responsible for identifying any known hazards on site.
07. Compliance & Gas Safety
All plumbing and gas fitting work is carried out in accordance with New Zealand standards and regulations. Gas work will only be performed where existing systems are compliant or can be made compliant. We are not responsible for defects in existing installations not directly related to our work.
08. Materials & Ownership
Materials supplied remain our property until full payment is received. Any unused materials remain our property unless otherwise agreed.
09. Warranties & Consumer Guarantees
Our workmanship is covered by the Consumer Guarantees Act 1993. Manufacturer warranties apply to supplied products and appliances. We are not liable for failures caused by misuse, lack of maintenance, or pre-existing issues.
10. Damage & Liability
We take care to protect your property; however, we are not responsible for unavoidable damage caused by accessing concealed or faulty plumbing systems. Our liability is limited to the value of the work carried out, except where required by law.
11. Cancellations
We require reasonable notice for cancellations. Late cancellations or no-shows may incur a call-out or cancellation fee.
12. Privacy
Any personal information collected will be used solely for providing our services and will not be shared with third parties except where required by law.
13. Governing Law
These Terms of Trade are governed by the laws of New Zealand.
14. Earthworks & Heavy Equipment
Where plumbing or gas work requires excavation or earthworks, we may use a 6-tonne digger or similar machinery. The customer must ensure safe and legal access for machinery, including sufficient space for operation, safe ground conditions, and removal of obstacles. Additional costs for earthworks (including labour, machinery, and disposal of excavated material) will be quoted before work begins. We are not responsible for damage to landscaping, fences, driveways, or other underground structures unless caused directly by our negligence. Work involving earthworks may require advance notice and scheduling adjustments/
